THE RECORDS

Israel Martinez

             (See Links/File #11) admitted at trial as (State's Exhibit #41). Israel was admitted at Parkland Hospital around 1:28am, June 9th 2001. His x-Rays were taken at 1:38am. Israel had two gunshot wounds.

            The first resulted in a fracture with associated metal fragments in the ulnar aspect of the distal humerus of his left arm. It is unclear whether that shot came from the back to front, or front to back. This bullet was item #8, recovered in Isabel's driveway.(Tr.R-111 at 120 and 132-133)

             The second bullet entered the left hip and came to a rest over the lateral aspect of the left hip. That bullet was not recovered. It was left inside of Israel. (Tr. R-111 at 41 lines 2-5) The caliber is unknown.

            Israel was discharged on June 11th 2001 wearing a removable cast.

Cynthia Gabriel Martinez

          (See Links/File #12) admitted at trial as (State's Exhibit #44). Cynthia arrived at Parkland Hospital at 1:16am, June 9th 2001. She was first X-rayed at 1:45am. She was then admitted to the OR at 2:22am.

          Cynthia has a gunshot wound to her left abdomen, which went into her left diaphragm and stomach and left 8th rib fracture.

         Cynthia was discharged from the Hospital on June 12th 2001.

Robert Poole

          Robert Poole was chief of the Physical Evidence Section at SWIFS. His testimony came from the testing results by Susan Allen, who did not appear at trial. Her report was admitted as (State's Exhibit #32 See Links/File 32)

         Both Poole and Allen contradicted Det. Berry's claims that the .38 caliber shell casing found inside Licho Escamilla's Cadillac did not match the slugs recovered from Santos, Israel, or Cynthia. Compare: (Tr. R-111 at 166-167) next to (Tr. R-111 at 175-176;178 and 181-182)

        Poole also admitted that based on his training, he could not conclude that State's Exhibit #8, #43 or #44 ( items 8, 21 and 28) were .38 Caliber bullets. (Tr. R-111 at 182 lines 13-23)

       

Dr.Timothy Sliter, M.D

        Dr. Sliter was a supervisor in the Forsenic Biology Labratory at SWIFS. He is an expert in DNA testing. (Tr. R-IV at 9-10)

        Dr. Sliter was a suporvisor in the Forsenics Biology Labratory at SWIFS. He is an expert in DNA Testing (Tr.R-Iv at 9-10)

       Using the buccal swabs collected by Susan Allen, Dr. Sliter performed a short tandem repeat DNA test (State's Exhibit #8). It matched Israel's DNA. That test was admitted as (State's Exhibit #33 See Links/File #14) (Tr.R IV at 12-19)

       No other ballistic expert; shooting reconstruction expert; or eyewitness was called or offered by either party.
